Adam L. Kochenderfer

 

  • Diverse commercial litigation practice addressing local, national, and international disputes at every level of complexity.
     
  • Representative clients include original equipment manufacturers, suppliers, landlords, tenants, secured and unsecured creditors, debtors, guarantors and distressed companies.

  • Expertise in representing clients in the enforcement of their contract rights in state and federal courts, arbitration, and mediation.

  • Broad experience representing original equipment manufacturers, tier-one suppliers, and sub- tier suppliers in a wide range of disputes, including:

    • Dealership franchise disputes

    • Supply disruptions
             
    • Pricing and volume disputes

    • Efforts to resource production to alternative suppliers

    • Lien claims under Michigan’s Special Tools Lien Act and Molder's Lien Act

    • Federal WARN Act litigation

    • Product liability claims 
       
  • Strong familiarity with disputes in a commercial bankruptcy context, including:

    • Fraudulent transfers

    • Debt recharacterization

    • Preference actions
       
    • Use of property under the Bankruptcy Code’s automatic stay

  • Experience addressing dealership franchise floor plan financing and competing creditor claims, including representation of an original equipment manufacturer in one of the largest dealership bankruptcies in U.S. history

  • Extensive background negotiating supply contracts addressing a variety of components produced both domestically and abroad.
     
  • Experience working with municipalities on a broad spectrum of land use matters, including rezoning parcels, obtaining variances, and addressing building code violations.
