Scott A. Wolfson’s and Anthony J. Kochis’ article, “News at 11: Golden Guernsey – A WARNing to Directors and Officers,” appears in the April 2016 issue of the American Bankruptcy Institute Journal. The article examines a recent decision from the Delaware Bankruptcy Court holding that a bankruptcy trustee had pled viable breach of fiduciary duty claims against directors and officers of the debtor company. Specifically, the trustee had alleged that the directors and officers breached their fiduciary duties to the bankrupt company by exposing it to Worker Adjustment and Retraining Notification Act claims.
